Summary: Ray acts on what he knows
Notes: I have been batting this around for a few days; finally decided to actually write and post it.  This week's [livejournal.com profile] ncisdrabble100 challenge offered the perfect opportunity for a prequel to this story.  Knowing can be found here.  You don't have to read it first, but it does "set the scene" so to speak and it's only 120 words. 

It had been a stressful week spent investigating the murder of a young marine involved in drugs, sex and rock & roll.  Ten years ago Tony might have been envious of the young man's life style of endless parties and women, but now he saw it for what it was - a sad and lonely waste of a young life going no where.

The team had a rare weekend off and he was looking forward to some downtime, the last several months had taken a toll on him both emotionally and physically. Tomorrow morning he was picking up his father from the airport for a rare birthday celebration, but tonight it was just him, his TV and the 1941 classic The Maltese Falcon.

He took a quick shower and pulled on a T shirt and a pair of pajama bottoms. He preferred to sleep naked, but liked the soft cotton pants for relaxing around the apartment. As a tribute to the movie that he was about to watch he opened a bottle of wine and cooked pasta with Vodka sauce instead of drinking beer and ordering a pizza.

Dimming the lights, he settles in with his dinner and loses himself in the movie. 

He is pulled from the world of Sam Spade by soft but persistent knocking on his door.  Glancing at his clock he sees it is only a little after 9:00 p.m. and smiles to himself - perhaps she has decided to take him up on his movie offer after all.  He paused the DVD and walked to the door, opening it with a flourish and a grin to find not the woman he was expecting, but the long absent boyfriend of said woman.

Tony was stunned speechless to find Ray Cruz standing in the hallway dressed in a wrinkled suit with a trench coat folded over his arm. 

Ray finally broke the awkward silence by saying "I'm sorry for coming by unannounced, but was hoping to have a word with you".

"About?" queried Tony recovering from his shock.

"Do you mind if I come in?"

Tony stepped back and allowed Ray to enter while motioning to the couch inviting Ray to sit.  He was uncomfortable with Ray in his home, but he would be civil to him - for her.

"Something to drink?" he asked.

Ray smiled and answered "No. Thanks.  This is isn't exactly a social call."

Tony walked around the couch and sat in the arm chair "What is it?"

"Ziva"

Tony was not surprised. "Does she know you're here?"

Ray grimaced slightly "No. I came straight here from the airport. She doesn't know I'm back"

Tony chuckled mirthlessly "You haven't seen or talked to her for five months, yet you come here first?"

Ray had the decency to look embarrassed, but replied "This is important."

Tony remained silent, this was Ray's rodeo.

Ray shifted uncomfortably on the couch and rubbed the back of his neck to relieve the obvious tension.  Tony remained passive on the outside, but on the inside his gut was churning.  Ray showing up at his door did not bode well.

"Did Ziva tell you that I proposed to her before I left?"

Tony felt his stomach clinch tighter, but his voice was steady as he answered "No. She told me that you gave her a ring box and that it was empty."

"It wasn't empty.  It contained a promise."

Tony gave Ray a deadpan expression - he would not give him the satisfaction of asking the question that Ray wanted to answer.

Ray sighed "I knew I was leaving the country for an extended period of time.  I couldn't ask her to marry me and then disappear for months.  It was a promise for when I returned.  She knew what I asking."

"Why are you here, Ray? Shouldn't you be having this conversation with Ziva?"

Tony saw Ray straighten his back and knew that they were finally getting to the crux of things.

"I am here to ask you to let her go"

Tony was not prepared for that and it caused him to stammer for the first time "I... I don't know what you mean"

Ray's eyes sparked with anger, but it was quickly veiled "I think you do"

Tony's own anger started to surface and he snarled "No. I don't"

Ray leaned slightly forward - almost in Tony's space "I know that you and Ziva have been dancing around each other for years. I know that you have feelings for her, but you are too afraid to tell her and that you will never commit to her.  I know that she has feelings for you and that they are not of a sisterly nature. I know that the two of you have grown closer over the past few months"

Tony mirrored Ray's actions and leaned into his space "You don't know anything"

Smirking Ray replied "I know that I love her and I can give her the things that you won't or can't."

Ray's face and voice softened "I know that if you were out of her life - perhaps each day she would love you less and perhaps love me more."

Tony had no response, so Ray continued "If you can't love her Tony, the way she deserves to be loved.  Let her go.  It's the right thing to do."

Tony leaned back in the chair and rubbed his face. His emotions were in turmoil and he had no words.

Ray stood up and walked to the door.  He opened it and then turned around "Tonight I am checking into a hotel, but tomorrow I am calling Ziva.  I will see her and I will ask her to marry me. I have a new box and it's not empty." 

Tony didn't know how long he sat in silence after Ray left.  It could have been minutes or it could have been hours.  

He wished that he and Ziva could have had more time. He knew that this day had to come - that Ray would eventually return and decisions would have to be made.

They both had emotional and relational baggage and they were only just now learning how to deal with it and with each other in this new phase of their relationship.  They were finally getting it right and now it seemed that they had run out of time.

He felt his heart start to mourn for what could have been.  And then it all clicked into place.

Anger at Ray flared up again - he knew what Ray was doing - the manipulative bastard.  He would not be tricked into pushing her away just because they weren't all the way there yet. They would get there and they would do it in their own time - of that he was confident.

As he thought more about it, he realized that he should be happy that Ray had finally returned.  He was an obstacle between them.  Ziva couldn't commit herself fully to trying with him while Ray was still in the picture and she was not the type of woman to sever a relationship by email or voice mail. She was waiting to do it in person, she hadn't actually said it, but he knew Ziva was done with Ray. He was confident that Ray's proposal would be met with a no.

And he almost felt sorry for the guy.  Almost.

This was so well done! This is perhaps THE best scene set b/w these two characters, in private. Bravo! And if you've never seen the movie, it's totally worth the time! ;>)

Fantastic! But, I'm scared about what Ziva's answer will be. I'm afraid having her just say no to Ray is too simple, and this is going to be an angsty mess before we're through.
