I think that he was using Franks gun and it ran out of bullets. Based on what Gibbs said in autoposy - Franks carried 8 with 1 in the chamber for a total of 9. They found 5 casings at the scene and one bullet from the thru and thru shot - that leaves 3 - P2P fired 3 shots at EJ's guys - so when he pulls the trigger on her, it's empty. Maybe giant agent recovers enough to pull him off EJ as he is already injured (speculation that Franks actually did hit him)and he runs off to fight another day.
OOh you are soooo good-counting bullets. Didn't even occur to me. And since you mentioned it...under the heading of "I don't think so" how ridiculous was it that her teeny tiny form was dragging a 275lb injured man around? Did the black guy get killed? Looked like he was shot in the neck.
very possible. Don't you think it is interesting how the writers went out of their to portray EJ and her team as close, but when they are injured, she disobeys an order from Vance to stay put and wait for back up to pursue the killer on her own? I mean both of her team members are down, possibly bleeding to death and all she gives them is a cursory glance? She pulls giant out the hall, but doesn't even offer first aid, she drops him and goes after P2P. I am sure she knew help was on the way, but when your bleeding from a gunshot wound, seconds count - and she just left them? Glad she's not on my side - rookie? you bet! ego? absolutely.
